Your privacy is important to us. It is zebraMD's policy to respect your privacy and comply with any applicable law and regulation regarding any personal information we may collect about you, including across our website, https://www.zebramd.org/, and other sites we own and operate.

Personal information is any information about you which can be used to identify you. This includes information about you as a person (such as your name and email address), your devices, and even information about how you use a website or online service.

In the event our site contains links to third-party sites and services, please be aware that those sites and services have their own privacy policies. After following a link to any third-party content, you should read their posted privacy policy information about how they collect and use personal information. This Privacy Policy does not apply to any of your activities after you leave our site.

HIPAA Protections

zebraMD will not use identifiable medical information for third party advertising or marketing purposes. We operate with the highest ethical standards to maintain Health Insurance Portability and Accountability Act (“HIPAA”) compliance, and strictly adhere to the following rules:

  • Privacy Rule: Establishes guidelines to protect Personal Health Information (“PHI”) and grants individuals specific rights concerning their health information.
  • Security Rule: Requires covered entities and their partners to implement measures that ensure the confidentiality, integrity, and security of electronic PHI.
  • Breach Notification Rule: Obligates covered entities to inform affected individuals, the federal government, and, in certain cases, the media when a breach involving unsecured PHI occurs.

This Privacy Policy provides general information about our data practices and does not replace or modify any separate Notice of Privacy Practices, Business Associate Agreement, or authorization that may govern PHI under HIPAA. To the extent zebraMD acts as a covered entity or business associate, its handling of PHI is governed by HIPAA and any applicable agreements, which will control in the event of a conflict with this Privacy Policy.

Protecting Your Medical Records

zebraMD is HIPAA compliant and protects your PHI. If you choose to upload your medical records, your information is processed using HIPAA-compliance infrastructure and secure cloud service providers, including AWS Textract, for purposes of extracting and analyzing relevant medical information in connection with the Services. Uploaded information may be retained only as reasonably necessary to provide the Services, maintain platform functionality and security, comply with legal obligations, support authorized research activities, and improve zebraMD's algorithms, analytics, and machine learning systems in accordance with applicable law and user authorizations.

Healthcare AI, Research, and De-Identified Data

zebraMD uses artificial intelligence, machine learning, natural language processing, and related technologies to assist with rare disease analysis, clinical pattern recognition, precision health recommendations, and related research and development activities.

Where permitted by applicable law and user authorization, zebraMD may use de-identified, aggregated, pseudonymized, or otherwise non-identifiable information derived from user submissions, medical records, genomic information, wearable data, audio/video files, and platform interactions for:

  • training, validating, and improving algorithms and machine learning models;
  • identifying phenotype-genotype correlations;
  • improving diagnostic methodologies;
  • conducting quality assurance and product improvement activities;
  • developing analytics and benchmarking tools;
  • academic research, validation studies, and scientific publication; and
  • developing new healthcare and precision medicine technologies and services.

Users may optionally consent to be contacted regarding clinical trials, research studies, patient registries, or related opportunities that may be relevant to their medical condition or genetic profile.

zebraMD does not sell PHI or identifiable medical records to data brokers or advertisers.

Any de-identified or aggregated data used for research or model development is processed in accordance with applicable law and industry-standard de-identification practices. Where zebraMD de-identifies information, it does so using methods intended to comply with applicable legal and regulatory standards for de-identification, although no de-identification process can guarantee zero re-identification risk.

De-Identified and Aggregated Data

Once information has been de-identified or aggregated such that it no longer reasonably identifies you, it is no longer treated as personal information or PHI under this Privacy Policy. zebraMD retains all right, title, and interest in de-identified, aggregated, and model-derived data and may use, retain, and disclose it for any lawful purpose, including research, product development, and improvement of its algorithms and Services, without further notice to you and to the extent permitted by applicable law. zebraMD commits not to attempt to re-identify de-identified information except as permitted by law to test its de-identification processes.

Life Sciences and Research Partnerships

zebraMD collaborates with pharmaceutical, biotechnology, life science, academic, and clinical research partners. In connection with these collaborations, zebraMD may use and share de-identified, aggregated, or otherwise non-identifiable data derived from the platform, for example, to help develop or validate diagnostic algorithms for specific conditions, to generate population-level insights (such as how many patients in our system have a particular condition), or to support research relating to specific rare or other diseases. zebraMD does not sell identifiable patient data or identifiable medical records, does not share identifiable PHI with these partners except with your authorization or as otherwise permitted by law, and does not use patient data for third-party advertising or marketing purposes.

Information We Collect

Information we collect falls into one of two categories: “voluntarily provided” information and “automatically collected” information.

  • “Voluntarily provided” information refers to any information you knowingly and actively provide us when using or participating in any of our services.
  • “Automatically collected” information refers to any information automatically sent by your devices in the course of accessing our products and services.

Log Data

When you visit our website, our servers may automatically log the standard data provided by your web browser. It may include your device's Internet Protocol (IP) address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details about your visit.

We may also use third-party cloud infrastructure providers, analytics providers, artificial intelligence providers, subprocessors, security vendors, and healthcare technology service providers to support operation of the platform and related services.

Certain platform features may rely on third-party artificial intelligence or cloud service providers operating under contractual privacy, confidentiality, and security obligations.

How We Share Information

zebraMD may disclose personal information, health information, and related data in the following circumstances, subject to applicable law and contractual obligations:

  • to cloud hosting providers, infrastructure providers, analytics providers, artificial intelligence providers, subprocessors, security vendors, and other service providers that support operation of the platform and related services;
  • to healthcare providers, caregivers, laboratories, researchers, clinical trial sponsors, life science partners, or authorized collaborators at the direction of users or as otherwise authorized by applicable law or consent;
  • to payment processors, billing providers, and financial service providers in connection with transactions or platform operations;
  • to affiliated entities, successors, acquirers, investors, or counterparties in connection with mergers, financings, acquisitions, reorganizations, asset sales, or similar corporate transactions;
  • to regulators, law enforcement agencies, courts, governmental authorities, or other third parties where required by law, subpoena, legal process, or to protect the rights, safety, security, or property of zebraMD, users, or others; and
  • to other parties where users have provided consent or directed zebraMD to share information.

zebraMD does not disclose identifiable Protected Health Information to third-party advertisers or data brokers for advertising purposes.

Consistent with applicable law, zebraMD may use or disclose information, including PHI, to appropriate authorities, agencies, or individuals where reasonably necessary to report or prevent suspected abuse, neglect, or exploitation of a child or vulnerable or elderly adult, to address a serious and imminent threat to the health or safety of an individual or the public, or to comply with public health reporting and other public health activities authorized by law. These disclosures may be made without your authorization to the extent permitted or required by law. Any such use or disclosure made in accordance with this Privacy Policy and applicable law will not constitute a breach of any confidentiality, privacy, or security commitment made by zebraMD to you.

In addition, zebraMD may use or disclose your identifiable health information, including PHI, where required by law, authorized by you, or otherwise permitted under applicable law, including for purposes such as treatment, payment, healthcare operations, and other legally authorized disclosures. Any such disclosures will be made only as permitted or required by applicable law and consistent with your authorizations and this Privacy Policy.

Security of Your Personal Information

When we collect and process personal information, and while we retain this information, we will protect it within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use, or modification.

zebraMD maintains administrative, technical, and physical safeguards designed to protect personal information and PHI, including access controls, encryption, audit logging, and incident response procedures appropriate to the nature of the information processed.

Although we will do our best to protect the personal information you provide to us, we advise that no method of electronic transmission or storage is 100% secure, and no one can guarantee absolute data security.

How Long We Keep Your Personal Information

We keep your personal information only for as long as we need to. This time period may depend on what we are using your information for, in accordance with this privacy policy. For example, if you have provided us with personal information such as an email address when contacting us about a specific inquiry, we may retain this information for the duration of your inquiry remaining open as well as for our own records so we may effectively address similar inquiries in future. If your personal information is no longer required for this purpose, we will delete it or make it anonymous by removing all details that identify you. Notwithstanding the foregoing, certain de-identified, aggregated, archived, backup, audit-log, security, research, or machine learning-derived information may be retained where permitted by applicable law.

However, if necessary, we may retain your personal information for our compliance with a legal, accounting, or reporting obligation or for archiving purposes in the public interest, scientific, or historical research purposes or statistical purposes.

Our retention periods vary depending on the type of information and the purpose for which it is held. In general, we retain: (i) account and contact information for as long as your account is active and for a reasonable period thereafter; (ii) uploaded medical records, genetic information, and other PHI for as long as reasonably necessary to provide the Services and as required by applicable law and any applicable authorizations; (iii) de-identified, aggregated, and research- or model-derived data for as long as permitted by applicable law; and (iv) security logs, audit records, and backups for periods consistent with our security and legal-compliance obligations. When information is no longer needed, we will delete, de-identify, or securely destroy it in accordance with applicable law.

Children's Privacy

We do not aim any of our products or services directly at children under the age of 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent, consistent with the Children's Online Privacy Protection Act (“COPPA”). Where a parent, legal guardian, or authorized representative uploads information about a minor, they represent that they have authority to do so. If we become aware that we have collected personal information from a child under 13 without the required consent, we will take reasonable steps to delete it. A parent or guardian may contact us using the details below to review, correct, or request deletion of a child's information.

Genetic Rights

Your genetic rights under US law are protected by GINA (Genetic Information Nondiscrimination Act). This means that no one can use your genetic information to limit access to health insurance or employment. However, it can be used to limit access to life insurance and long-term care insurance. zebraMD does not recommend sharing or selling your own genetic information unless it is anonymous. Your name is not used in the analysis of your genomic information to recommend precision health management. Patients can choose to share both their genomic data and the resulting precision health recommendations (or only one or the other) with their physician if desired.

Genetic Data Consent and Disclosure

Because we process genetic and genomic information, additional protections may apply under the Genetic Information Nondiscrimination Act (“GINA”) and state genetic privacy laws (including the Illinois Genetic Information Privacy Act and various state direct-to-consumer genetic testing laws). Where required by applicable law, we will obtain your separate, express consent before collecting, analyzing, retaining, or disclosing your genetic information, and we will not disclose your genetic information to insurers, employers, or other third parties except as authorized by you or permitted by law. You may withdraw consent to the collection and use of your genetic information at any time, subject to processing that has already occurred and to retention permitted by applicable law.

Biometric Information

Certain information we process, such as audio and video files and other biometric identifiers, may constitute biometric information under laws including the Illinois Biometric Information Privacy Act (“BIPA”), the Texas Capture or Use of Biometric Identifier Act, and the Washington biometric privacy law. Where these laws apply, we will provide notice and obtain consent before collecting biometric information, will not sell or lease biometric information, and will retain it only as long as reasonably necessary to provide the Services and satisfy legal obligations, after which it will be securely destroyed in accordance with our retention schedule and applicable law.

No Medical Advice

zebraMD provides clinical decision support technology and healthcare navigation services. zebraMD's platform is intended to support informational, research, and clinical decision-support activities only and does not constitute medical advice, diagnosis, or treatment. zebraMD does not replace the judgment of licensed healthcare providers and does not independently diagnose medical conditions, prescribe medications, or determine treatment plans; all medical decisions remain the responsibility of the patient and their treating healthcare providers. Clinical decision support and health information are provided for healthcare providers to use at their own discretion, and AI-generated health insights are provided for patients to use at their own discretion. Patients should discuss any resulting health insights with their healthcare provider before taking any action, and such insights are for informational purposes only. Artificial intelligence and machine learning outputs may contain inaccuracies, incomplete information, or recommendations that are not appropriate for every individual clinical circumstance, and should be independently reviewed and validated by qualified healthcare professionals. Users should not disregard professional medical advice or delay seeking medical treatment based on information generated through the platform. The platform is not intended for medical emergencies; in an emergency, call 911 or go to the nearest emergency department.

Your Responsibilities

You are responsible for the accuracy and completeness of the information you provide to us and for keeping it up to date. If you provide information about another individual, including a patient, dependent, or family member, you represent and warrant that you have obtained all consents, authorizations, and permissions required by applicable law to provide that information to us and to permit its processing as described in this Privacy Policy. We may rely on the accuracy of information and the authority of any person submitting it, and we are not responsible for inaccuracies or unauthorized submissions by users or third parties.

Certain platform features may be investigational, research-oriented, or not intended for use as the sole basis for clinical decision-making.

Automated Processing and Profiling

zebraMD uses artificial intelligence and machine learning to analyze information and generate insights, pattern recognition, and precision health recommendations. These outputs are intended to support, not replace, the independent judgment of qualified healthcare professionals, and zebraMD does not use automated processing to make decisions that produce legal or similarly significant effects about you without appropriate human involvement. Where required by applicable law, you may have the right to obtain information about the logic involved in certain automated processing, to object to such processing, or to request human review, and you may exercise these rights by contacting us using the information below.

Your Rights and Controlling Your Personal Information

  • Certain information processed by zebraMD may constitute PHI governed by HIPAA, while other information may be governed by general privacy laws or consumer privacy laws. Where HIPAA applies, zebraMD handles PHI in accordance with applicable HIPAA requirements and related contractual obligations.
  • Your choice: By providing personal information to us, you understand we will collect, hold, use, and disclose your personal information in accordance with this privacy policy. You do not have to provide personal information to us; however, if you do not, it may affect your use of our website or the products and/or services offered on or through it.
  • Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this privacy policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person's consent to provide the personal information to us. Healthcare providers, caregivers, and authorized representatives using the platform are responsible for obtaining any legally required consents, authorizations, and permissions before uploading or sharing patient information with zebraMD.
  • Access: You may request details of the personal information that we hold about you.
  • Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, please contact us using the details provided in this privacy policy. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading, or out of date.
  • Non-discrimination: We will not discriminate against you for exercising any of your rights over your personal information. Unless your personal information is required to provide you with a particular service or offer (for example providing user support), we will not deny you goods or services or provide you with a different level or quality of goods or services.
  • Notification of data breaches: We will comply with laws applicable to us in respect of any data breach. Where a breach involving your personal information or PHI is likely to result in a risk to your rights, we will notify affected individuals, applicable regulators, and, where required, other parties without undue delay and consistent with the timeframes required by HIPAA, the GDPR, and applicable state breach-notification laws.
  • Complaints: If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint.
  • Handling of requests: Before acting on any request regarding your personal information, we may require you to verify your identity and, where you use an authorized agent, to confirm that agent's authority. Where permitted by applicable law, we may decline, or charge a reasonable fee for, requests that are manifestly unfounded, repetitive, or excessive, and we may retain information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and maintain security.

Cookies and Tracking Technologies

zebraMD and its service providers may use cookies, pixels, local storage objects, SDKs, analytics tools, and similar tracking technologies to operate, secure, analyze, and improve the platform and user experience. These technologies may collect information regarding device identifiers, browser type, operating system, usage activity, session information, IP address, and interactions with the platform.

Some tracking technologies are necessary for platform functionality, security, authentication, fraud prevention, and performance monitoring, while others may be used for analytics, research, and service improvement purposes.

Users may be able to control certain cookies or tracking technologies through browser settings or device-level preferences; however, disabling certain technologies may affect platform functionality.

Use of Google Analytics

We use Google Analytics and similar analytics technologies to help us understand how users interact with the App and improve platform performance and functionality. Google Analytics collects information such as how often users visit the App, what pages they visit, and what other apps they used before coming to the App. Google Analytics collects only the IP address assigned to you on the date you use the App, rather than your name or other identifying information. We do not combine the information collected through Google Analytics with personally identifiable information.

Business Transfers

If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data, including your personal information, among the assets transferred to any parties who acquire us. General; Relationship to Other Terms

This Privacy Policy supplements, and should be read together with, any Terms of Service or other agreements between you and zebraMD. By using our platform and Services, you acknowledge and, where required by applicable law, consent to the processing of your information in the United States and other jurisdictions where zebraMD and its service providers operate, including processing using cloud infrastructure and artificial intelligence systems, which may have data protection laws that differ from those in your jurisdiction. We take steps to ensure such transfers are subject to appropriate safeguards as described above.

Where required by the GDPR or UK GDPR, zebraMD has appointed a representative in the European Union and/or United Kingdom and, where applicable, a Data Protection Officer, who may be contacted using the details in the Contact Us section. You also have the right to lodge a complaint with your local data protection supervisory authority.

Your Rights and Controlling Your Personal Information

  • Restrict: You have the right to request that we restrict the processing of your personal information if (i) you are concerned about the accuracy of your personal information; (ii) you believe your personal information has been unlawfully processed; (iii) you need us to maintain the personal information solely for the purpose of a legal claim; or (iv) we are in the process of considering your objection in relation to processing on the basis of legitimate interests.

  • Deletion: You may have a right to request that we delete the personal information we hold about you at any time, and we will take reasonable steps to delete your personal information from our current records. If you ask us to delete your personal information, we will let you know how the deletion affects your use of our website or products and services. There may be exceptions to this right for specific legal reasons which, if applicable, we will set out for you in response to your request. Deletion of account information may not result in deletion of de-identified, aggregated, archived, backup, audit-log, security, research, or machine learning-derived information where retention is permitted by applicable law. Please be aware that search engines and similar third parties may still retain copies of your personal information that has been made public at least once, like certain profile information and public comments, even after you have deleted the information from our services or deactivated your account.

Additional Disclosures for California Compliance (US)

Under California Civil Code Section 1798.83, if you live in California and your business relationship with us is mainly for personal, family, or household purposes, you may ask us about the information we release to other organizations for their marketing purposes.

To make such a request, please contact us using the details provided in this privacy policy with “Request for California privacy information” in the subject line. You may make this type of request once every calendar year. We will email you a list of categories of personal information we revealed to other organisations for their marketing purposes in the last calendar year, along with their names and addresses. Notice of Financial Incentive

zebraMD does not offer financial incentives or price or service differences in exchange for the collection, sale, or retention of personal information.
